Conditions of Sale

Registration - Please register with Artfact early. We do not accept internet auction registration after 2 hours prior to the auction, or during the auction. Approval of bidders is at the discretion of SAH, and we have the right to refuse any bidder or opening bid.

Payment - by cash, check, wire transfer, Visa or MC. We do not accept Paypal. Buyers premium is 23% (includes the online fee). The purchaser assumes complete responsibility for items once the auctioneer says 'sold.' Failure to make payment promptly will result in a filed complaint to Artfact, and any further bidding with Artfact will be stopped until payment is received. The buyer must pay the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges) NO LATER THAN 10 DAYS FOLLOWING THE SALE. Massachusetts sales tax of 6.25% may be applicable. We reserve the right to hold merchandise until checks or credit card clears. There will be a $40. fee for a bounced check.

Packing and Shipping - P&S is the responsibility of the buyer, it is not included in the hammer price. We can arrange for shipping through local agents, but SAH will not be responsible for the acts or omissions of carriers or packers whether or not recommended by us. All items must be removed, or shipping arrangements made with SAH, within 21 days of the auction, or a fee of 1% will be applied to each lot stored for every day of storage over 21 days.

Condition Reports - SAH is not responsible for the correctness of any statement of any kind concerning any lot nor for any other errors or omissions in description or for any faults or defects in any lot. All items are sold 'as is' and without recourse. All measurements and weights are approximate. Neither the seller or ourselves give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to description, size, quality, condition, attribution, authenticity, importance, medium, or provenance. Any warranty of any kind whatsoever is excluded by this paragraph, except as required by local law. Auction preview is open to the public - prospective buyers are strongly advised to personally examine any property in which they are interested before the auction takes place. Condition reports are available by request. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition.
